DHS proposes to end the 60-day grace period after a job ends
A proposed rule would remove the grace period of up to 60 days for certain nonimmigrant workers and their dependents. It is not in force; comments are open until November 10, 2026.
The Department of Homeland Security proposes to remove the regulation at 8 CFR 214.1(l)(2). That regulation gives aliens in certain nonimmigrant classifications, and their dependents, a grace period of up to 60 days when their employment ends before their authorized stay expires.
This is a proposal. Nothing changes until DHS publishes a final rule. Written comments are accepted through November 10, 2026.
