9-11 biometric fee now applies to all H-1B and L-1 extension petitions of covered employers
A DHS final rule effective September 9, 2026 requires covered employers to pay the fee for every extension of status petition, including those without a change of employer.
The Department of Homeland Security amended the regulations on the 9-11 Response and Biometric Entry-Exit Fee for certain H-1B and L-1 petitions. Covered employers must now submit the fee for all extension of status petitions, including extensions that do not involve a change of employer.
The fee continues to apply unchanged to petitions seeking an initial grant of status. The rule is effective September 9, 2026.
