Commercial driver's licenses for non-domiciled drivers limited to certain work visa holders
A final rule of the Federal Motor Carrier Safety Administration, effective March 16, 2026, limits who can get a non-domiciled commercial learner's permit or CDL.
The Federal Motor Carrier Safety Administration amended the federal regulations for state driver's licensing agencies that issue commercial driving credentials to non-domiciled individuals. The final rule reaffirms, with minor changes, the interim final rule published on September 29, 2025.
It limits eligibility for non-domiciled commercial learner's permits and commercial driver's licenses for foreign-domiciled individuals to those who hold specific, verifiable employment-based nonimmigrant status. The rule is effective March 16, 2026.
Noncitizen truck and bus drivers who hold or apply for a non-domiciled CDL. Your state licensing agency applies the rule.
