USCIS rule writes the asylum fees, the I-94 fee and work permit validity limits into regulation
The interim final rule, effective May 29, 2026, codifies the asylum application fee and the annual asylum fee, including what happens if they are not paid.
The Department of Homeland Security issued an interim final rule that codifies immigration fees and other provisions required by the H.R. 1 law.
The rule amends USCIS regulations to codify the asylum fee and the annual asylum fee, including the consequences of not paying them; the new Form I-94 fee requirement; the validity period for certain types of employment authorization; and the retention of the Form I-589 filing fee for every application. It took effect on May 29, 2026.
Asylum applicants, people who receive a Form I-94, and applicants for work permits in the categories covered by the rule.
