New EB-5 investor fees take effect on November 30, 2026
A final rule adjusts USCIS fees for the EB-5 immigrant investor program and writes parts of the 2022 EB-5 reform law into the regulations.
USCIS published a final rule that adjusts the fees for EB-5 immigration benefit requests. The rule also codifies provisions of the EB-5 Reform and Integrity Act of 2022 and implements new statutory requirements.
The rule is effective November 30, 2026. Any application, petition or request postmarked on or after that date must include the new fees.
