DHS proposes raising the fee after an in absentia removal order to $18,000
The proposed rule would raise the fee from $5,130. It applies to certain people ordered removed in their absence who do not depart and are later arrested by ICE. It is not in force.
The Department of Homeland Security proposes to update a fee created by the H.R. 1 law. The fee applies to certain aliens ordered removed in absentia who fail to depart the United States and are subsequently arrested by ICE.
DHS proposes to increase the fee from $5,130 to $18,000 and to adjust it for inflation each year. Comments were accepted through June 22, 2026. The increase to $18,000 is a proposal; a separate notice sets the current inflation-adjusted amount at $5,300 from October 16, 2026.
