The powers, the notary, the apostille

A power of attorney has three parts that matter: the list of powers granted, the notary's certification with the register number and fee, and the apostille if it was issued for use abroad. Each is translated in full and in place.

Powers listed word for word

Each power, its scope and any limits, including the right to delegate, are translated literally. Legal sentences are kept as sentences, not summarized.

Notary block and register number

The notary's name, district, register entry number, fee and the security form number are translated or described.

Validity period

The date of signing and the period or date of expiry are converted to the US format and kept visible.

Apostille

Notarial or consular, both certified the same way

A power of attorney is certified either by a notary in the country of issue or by a consular officer at that country's consulate abroad. The certification block differs, and so does the apostille question.

  • Pages certified by a consular officer, with the consulate's stamp, a consular register number and the fee

  • Asked for by the same offices, usually when the principal lives in the US

How many pages is a power of attorney?

Do I need an apostille for use in the US?

Often yes for courts, banks and title companies, and it is obtained in the country of issue before translation. Ask the receiving office; the apostille is translated with the document when you have it.

Can you translate a power of attorney issued at a consulate?

Yes. Consular powers of attorney carry a consular certification instead of a notary's, and that block is translated in the same way.

Do you translate the security form number?
